1. Introduction

Talent Secure ("Company," "we," "us," or "our") is committed to protecting the personal information of individuals whose data we collect, process, and store in connection with our enterprise background screening services. This Privacy Policy explains how we collect, use, disclose, and safeguard information about applicants, candidates, and our corporate clients.

This Policy applies to all personal data processed through our platform, website, and related services. By using our services, you acknowledge you have read and understood this Privacy Policy.

2. Information We Collect

In providing background screening services, we may collect the following categories of personal information:

  • Full legal name, date of birth, and Social Security Number
  • Current and prior residential addresses
  • Employment history and professional references
  • Educational credentials and transcripts
  • Criminal history records obtained from authorized sources
  • Motor vehicle and driving records (where applicable)
  • Drug and health screening results (where applicable and authorized)
  • Government-issued identification documents

3. How We Use Your Information

We use collected information solely for the purposes of providing background screening services as authorized by our corporate clients and consented to by the subject individual. Specifically, we use data to:

  • Conduct employment background verifications as requested by authorized employer clients
  • Verify identity and confirm the accuracy of information provided
  • Comply with applicable federal and state laws including the Fair Credit Reporting Act (FCRA)
  • Improve the accuracy and efficiency of our screening platform

4. FCRA Compliance

Talent Secure operates as a Consumer Reporting Agency (CRA) as defined under the Fair Credit Reporting Act, 15 U.S.C. Β§ 1681 et seq. We are fully compliant with all FCRA requirements, including permissible purpose, adverse action procedures, and dispute resolution rights.

Individuals have the right to dispute the accuracy of information contained in their consumer report. Disputes may be submitted in writing to our compliance team. We will investigate and respond within the timeframe required by law.

5. Data Security

We implement industry-standard technical and organizational security measures to protect personal information against unauthorized access, disclosure, alteration, or destruction. This includes AES-256 encryption, SOC 2 Type II certified infrastructure, role-based access controls, and regular security audits.

6. Data Retention

We retain consumer report data for a minimum of seven (7) years in accordance with FCRA requirements and applicable state law. After the retention period, data is securely destroyed using industry-standard methods.

1. Agreement to Terms

By accessing or using the services provided by Talent Secure ("Company"), you agree to be bound by these Terms and Conditions. If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these terms.

If you do not agree to these terms, you may not access or use our services.

2. Permissible Use

Our background screening services may only be used for lawful purposes and in accordance with the Fair Credit Reporting Act (FCRA). Authorized permissible purposes include:

  • Employment screening for prospective or current employees
  • Tenant screening with required consent
  • Business partner or vendor due diligence as permitted by law
  • Other purposes expressly permitted under the FCRA

Use of our services for any purpose not authorized under the FCRA is strictly prohibited and may result in immediate termination of access and legal action.

3. Client Responsibilities

Corporate clients who access our platform agree to the following obligations:

  • Obtain proper written consent from candidates prior to ordering any background report
  • Provide candidates with required FCRA disclosures prior to ordering reports
  • Follow all FCRA and applicable state adverse action procedures when declining to hire based on report findings
  • Maintain the confidentiality of all consumer report information
  • Use report information only for the permissible purpose disclosed to the candidate
  • Not re-sell, redistribute, or share consumer reports with unauthorized third parties

4. Accuracy and Disputes

Talent Secure makes every reasonable effort to provide accurate and up-to-date information. However, as information is sourced from third-party court systems, educational institutions, and other external sources, we cannot guarantee absolute accuracy in all cases.

Candidates who wish to dispute the accuracy of information in their consumer report must notify us in writing. We will conduct a reasonable investigation and respond within the timeframe required under the FCRA.

5. Limitation of Liability

To the maximum extent permitted by applicable law, Talent Secure shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services. Our total liability for any claim arising under these terms shall not exceed the fees paid by the client for the specific screening service giving rise to the claim.

6. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the United States and the applicable laws of the state in which services are primarily rendered. Any dispute arising under these terms shall be subject to binding arbitration in accordance with the American Arbitration Association rules.

7. Modifications

We reserve the right to modify these Terms and Conditions at any time. Clients will be notified of material changes via email or platform notification. Continued use of our services after such notice constitutes acceptance of the updated terms.
